Why are prisoners categorised?

Some time after sentencing, adult male prisoners are assigned to the correct security category and allocated to an appropriate prison. Categorisation is based on the level of risk a prisoner might pose to the public or national security should they escape and the likelihood of their making attempts to do so.

What are the categories?

Prisoner categories in England and Wales

There are four different security categories:

Category A – Category A prisoners are those that would pose the most threat to the public, the police or national security should they escape. Security conditions in category A prisons are designed to make escape impossible for these prisoners.

Category B – Category B prisoners do not need to be held in the highest security conditions but, for category B prisoners, the potential for escape should be made very difficult.

Category C – Category C prisoners cannot be trusted in open conditions but are considered to be prisoners who are unlikely to make a determined escape attempt.

Category D – Category D prisoners can be trusted in open conditions.

Prisoner categories in Scotland

High Supervision A prisoner for whom all activities and movements should be authorised, supervised and monitored by an officer.

Medium Supervision A prisoner whom activities and movements are subject to limited supervision and restrictions.

Low Supervision A prisoner for whom activities and movements are subject to minimum supervision and restrictions. Prisoners in this category may be allowed to participate in activities in the community, which may be supervised or unsupervised.

On arrival in prison, each prisoner will initially be treated as high supervision. However within 72 hours of the prisoner’s arrival in prison, the prison governor will make an assessment of the prisoner and assign an appropriate category.

Female prisoners and young offenders

Unless they have been deemed category A then female prisoners and young offenders are not categorised. They are only classified as suitable for open conditions or suitable for closed conditions.

Does someone stay the same category throughout their whole sentence?

This depends on the length of sentence. In England and Wales, Category B and C prisoners who have a sentence of 12 months to 4 years should have their category reviewed at six monthly intervals. Anyone in the last 30 months of their sentence should also have their category reviewed at the same frequency. Category B and C prisoners with sentences of 4 years or more will have their categorisation reviewed on an annual basis. Category A prisoners will not have their first category review until 2 years after their initial categorisation.

In Scotland, the prison governor will make a formal review within six months and may assign a different category if necessary.Following this review, the governor must carry out another review at least once in every 12 month period.

If a prisoner is deemed to pose less of a risk to the public or they are considered less likely to make an attempt on escape then they may be moved to a lower category. Similarly, if the prisoner is considered to be more of a risk then their category may be raised.

Can a prisoner appeal against their security category?

If a prisoner is not happy with the results of their re-categorisation after a review then they can pursue their complaint through the prison complaints system. It may, in some cases, be possible to challenge the decision via a judicial review but only if the decision is unlawful or made without following the correct procedure. In such cases legal advice must be sought. The Prison Service has a duty to give reasons for their decisions relating to categorisation so it is important to have these in writing before any appeal is mounted.

Bulgarian Telecommunications Company (VIVACOM) concluded contract with Gazprom Space Systems, to use satellite capacity for VSAT data and broadcasting services. VIVACOM will use Yamal-402 satellite capacity in Ku-band in European-Southern Beam for VSAT data transmission and media services.

Uplink is done from VIVACOM’s own teleport in Bulgaria - Plana.

VIVACOM is the largest telecommunication company in Bulgaria in terms of revenues for five consecutive years. The portfolio of its services is wide with includingmobile, TV, Internet, and fixed services.

Gazprom Space Systems and VIVACOM intend to further expand their partnership in order to build VSAT data networks and video distribution in different regions.


The financial results for the first quarter of 2018 show a steady growth of mobile market share.

of BGN 223 million for the first quarter of 2018. The Company reports 5.6% growth compared to same period last year. Despite the highly competitive market environment, VIVACOM reports stable adjusted EBITDA growth of 11.6% to BGN 86 million. VIVACOM continues to increase its revenues from mobile services, achieving nearly 30% market share with 3 048 000 mobile subscribers, 89% of which are using postpaid subscriptions. The share of mobile data revenue from mobile service revenue continues to grow, reaching 41% in the first quarter of 2018, compared with 34% for the same period in 2017.

The positive trend above is supported by extension of the 4G network to 99% of the population, measured by GWS. [2]

VIVACOM is the leading operator in provision of the most advanced television service - interactive TV (IPTV). 47% of 451,000 pay-TV subscribers have chosen the interactive television during the first quarter of 2018, which represents 4 percentage points increase over the same period last year.

Today Bulgarian Telecommunications Company EAD (“VIVACOM”) successfully completed the refinancing of its EUR 400 million Senior Secured Notes (“SSN”) ahead of their maturity date. The Company has delisted the SSN from the Official List and from trading on the Main Securities Market of the Irish Stock Exchange.

19.04.2018, Sofia –Today Bulgarian Telecommunications Company EAD (“VIVACOM”) successfully completed the refinancing of its EUR 400 million Senior Secured Notes (“SSN”) ahead of their maturity date. The Company has delisted the SSN from the Official List and from trading on the Main Securities Market of the Irish Stock Exchange.

The refinancing was performed following successful negotiation of EUR 345 million Senior Facilities Agreement (“SFA”) with a syndicate of more than a dozen financial institutions. The SFA is comprised of several tranches with maximum tenor of 5.25 years and interest rates based on EURIBOR plus margins between 1.25% and 3.75% per annum. The financial terms of the new financing are significantly more favorable to the Company than those of the SSN, which would allow VIVACOM to focus on its development program with further investments in network infrastructure and the quality of its services.

In 2017 VIVACOM improved its financial performance and managed to decrease the net leverage ratio (calculated as ratio of Net debt to Adjusted EBITDA) to below 2.0, and the liquidity position of the company remains strong after the refinancing.

Recently Moody’s Investors Service (“Moody’s”) has upgraded the long-term credit rating of VIVACOM to “Ba3” from “B1”. The higher rating reflects the Company''s solid performance and its position as a leading telecom operator in Bulgaria with high market shares in fixed-line business, strong track record of growing mobile market share and revenues, as well as the expectations for further growth and development.


Notice of Redemption issued by Bulgarian Telecommunications Company EAD

Dated: March 19, 2018

Reference is hereby made to the indenture dated as of November 22, 2013 (as supplemented, amended or modified from time to time, the " Indenture "), among, , Bulgarian Telecommunications Company EAD (the " Issuer "), U.S. Bank Trustees Limited as trustee (the “ Trustee ”) and Elavon Financial Services DAC (formerly called Elavon Financial Services Limited) , UK Branch, as paying agent (the " Paying Agent ") and transfer agent. Capitalised terms used but not otherwise defined herein shall have the meaning assigned to them in the Indenture.

Pursuant to Section 3.03 of the Indenture, notice is hereby given by the Issuer that subject to paragraph 2, below, the Issuer has elected to redeem all of the Notes and the Issuer hereby provides the following information relating to the redemption of the Notes:

1. Subject to paragraph 2, below: a. the redemption date will be April 19, 2018 (the "Redemption Date"); b. the record date will be April 18, 2018 (the "Record Date"); c. the Issuer will redeem 100% of the principal amount outstanding of the Notes; d. the Notes are to be redeemed according to Section 3.07(e) of the Indenture and Paragraph 5(e) of the Notes; e. the Notes will be redeemed at a redemption price of 100.000 % (the " Redemption Price") of the principal amount of the Notes to be redeemed plus accrued and unpaid interest to, but not including, the Redemption Date in an amount equal to €11,336,111.11 per €400,000,000 principal amount of Notes plus Additional Amounts, if any (together with the Redemption Price, the "Redemption Payment"); and f. on the Redemption Date, the Redemption Payment will become due and payable upon the Notes and, unless the Issuer defaults in making the Redemption Payment, interest on the Notes shall cease to accrue on and after the Redemption Date. 2. The redemption of the Notes is subject to the satisfaction (as determined by the Issuer in its sole and absolute discretion) of the following conditions precedent: (a) the Issuer has satisfied all conditions precedent and any other requirements such that it has become entitled to draw and has made a utilisation request to draw facilities in a principal amount of at least €345,000,000 under a senior facility agreement dated December 22, 2017; and (b) the receipt in euros at least one Business Day prior to the Redemption Date by the Trustee or (if designated by the Trustee) the Paying Agent of the proceeds of the facilities referred to in paragraph 2(a) above and such other funds sufficient to pay the Redemption Payment on the Redemption Date. Accordingly, in the Issuer''s sole discretion, the Redemption Date and the corresponding Record Date may be moved to such earlier or later time as specified by the Issuer or the redemption may not occur and this notice may be rescinded in the event that either of the conditions precedent described in this paragraph 2 are not satisfied (or waived by the Issuer in its sole discretion) by the Redemption Date, or by the Redemption Date as so moved; provided that, in each case, the Issuer sends a supplemental notice to this Notice of Full Redemption indicating the new redemption date and corresponding record date as so moved.

Payment of the Redemption Payment in respect of Definitive Registered Notes will only be made upon presentation and surrender of the Notes to the Paying Agent at the place set forth below:

The method of delivery is at the option and risk of the Holder. Payment of the Redemption Payment in respect of any Notes that are held in book-entry form will be made to the relevant clearing system, which will distribute such payments to participants in accordance with their customary procedures.

The Common Code and ISIN numbers are included solely for the convenience of the Holders. The Issuer, the Trustee and the Paying Agent are not responsible for the use or selection of these numbers, nor is any representation made as to the correctness or accuracy of such numbers printed on the Notes or as listed in this Notice of Full Redemption. Reliance may be placed only on other identification numbers printed on the Notes. Redemption of the Notes shall not be affected by any defect in or omission of such numbers.

The Company presented its 2017 results in an Integrated Annual Report

The Company retains its leading position on the Bulgarian telecom market for fifth consecutive year with total revenue of BGN 890 million , which is an increase of 1.6% compared to 2016. The telecom also marks steady growth of 2.7% in adjusted EBITDA.
